Parents of fallen New York firefighter sue owner of home where he succumbed

The parents of fallen Mount Marion Fire Department Capt. Jack Rose have filed a lawsuit alleging negligence on the part of the owner of the home where Rose succumbed while fighting a fire in December 2015. Joe O’Connor, the lawyer representing Gary and Linda Rose, said an addendum to the suit is likely to be filed within a month and “may include other entities.” Rose, 19, died Dec. 19, 2015, after going into distress while helping fight a chimney fire in a home at 11 Fel Qui Road in the Centerville Fire District in Saugerties. Investigators concluded the fire was accidental, began in the structure’s south wall and involved a heating system and wood stove on that wall. O’Connor, though, said negligence is to blame. “The wood stove was negligently attached to a chimney that shouldn’t have been utilized,” he said.
