A tiny Arizona fire district's ability to terminate its two oldest employees will take center stage in Washington, D.C., as the U.S. Supreme Court hears arguments on the first day of its new session this fall — possibly with a new justice already seated. In a brief order Monday, the court put John Guido and Dennis Rankin's case against the Mount Lemmon Fire District on the Oct. 1 agenda. What the justices rule will most immediately affect whether the district's two oldest employees, before they were let go, have a right to sue under federal age discrimination law. The high court's eventual decision will have broader implications. A myriad of state and local government organizations and their allies filed their own legal brief telling the justices that they should side with the fire district and block the ability of the two fired workers to sue.
