While the city is nearing a decision on hiring a new fire chief, the final determination on a court case involving former Fire Chief Mark Marentette may not be coming any time soon.
Marentette in June filed an appeal of his termination in state Supreme Court and is seeking a return to his job with the city. The two sides appeared before Judge William Kocher in July.
Marentette challenged the outcome of his Civil Service hearing and his termination, based on a preponderance of evidence, which is a legal standard of proof that a fact or event was more likely than not to have occurred.
Kocher, in a decision filed in the Ontario County clerk’s office on Aug. 14, said Marentette and his attorney did not raise any issues that require the court to dispose of the matter.
