A local man is suing the city and its police and fire departments over his arrest following a fire last year.
Rochester attorney Kevin Clark filed the lawsuit Aug. 16 in federal court on behalf of Joseph Tracey. Tracey was arrested after police and firefighters responded to a barn/shed fire on Reed Street just after 5 a.m. Aug. 15, 2016.
Tracey was accused of threatening police officers with a rifle at the scene. He originally was charged with menacing a police or peace officer, a felony. Jason MacBride, an assistant Ontario County district attorney, said the charge was later reduced to misdemeanor menacing since no law enforcement officers were targeted. The case is still pending in city court.
