The man who allegedly drove a stolen truck into a Fremont County Sheriff's Office vehicle after starting an RV fire in Coaldale more than a year ago has been restored to competency. Pueblo District Court Judge Scott Epstein, who was assigned to one of Robert Lee Fay's five pending court cases because Fremont County District Court Judge Lynette Wenner is a witness to one of the assault cases, said Friday that preliminary findings from the Colorado Mental Health Institute at Pueblo show that Fay is competent to proceed with trial. Fay's appearance in court was waived Friday, but his attorneys, Colorado Springs Attorney Philip Dubois and defense attorney Jason Kosloski, both of whom appeared by phone, said they would like more time to consider the finding and do some investigating of their own before accepting CMHIP's competency evaluation.
