An East Wenatchee man arrested in a damaging fire last year at the Aspen Heights apartment complex has entered a plea deal with Chelan County prosecutors, after they could not prove he was responsible for the blaze.
Devin Andrew Rushing, 21, pleaded guilty Monday to a count of third-degree malicious mischief, a gross misdemeanor, and received a total jail sentence of 15 days, which he's already served. Rushing was initially charged with felony first-degree arson for allegedly discharging a firework from a moving car that started the July 18, 2021 fire.
Rushing, the driver of the car, said the firework was thrown by a passenger, who was never identified by investigators. Wenatchee police said that firework set shrubbery ablaze on a slope just below the apartments, and the flames quickly spread to the building.
